TZO appropriate uses

TZO.COM Service Agreement - When you use our TZO.COM Services you agree to abide by the terms and conditions of our Service Agreement ("Agreement"). If there is a contradiction between any information on the TZO.COM web site, and this Service Agreement, the Service Agreement prevails unless the information on the web site reflects a narrower responsibility on behalf of The Tzolkin Corporation. If you cannot agree to abide by all of the terms and conditions of this Policy, then please do not use a TZO.COM Service. You are responsible for continual compliance with this Agreement as well as any amendments to it as posted on our web site.

Abuses of the TZO.COM Service - You agree to use TZO.COM Services only for lawful purposes. The Tzolkin Corporation reserves the right to terminate any customer account or agreement for which a domain hosted by The Tzolkin Corporation is found to be pointing or otherwise directing traffic to any material in violation of any US or State statute or regulation and/or a TZO.COM Service or Services are used to point to web sites or locations that create, transmit, distribute or store material that: violates US export control laws; impairs the privacy of communications; violates US trademark, copyright, trade secret or other intellectual property law; may be threatening, abusive or hateful, violates the privacy, publicity or other personal rights of others; and/or encourages conduct that would constitute a criminal offense or give rise to a civil liability.

Furthermore, any misuse of TZO.COM Services or resources that disrupts or attempts to disrupt the normal use of our system, services, or business is strictly prohibited. Abusive uses, including facilitating, aiding or encouraging such uses, will lead to suspension of the customer account. Any attempts to penetrate The Tzolkin Corporation security will result in the immediate suspension of the customer account and agreement without notice, as well as notification of appropriate law-enforcement agencies.

Unacceptable uses of the TZO.COM Service - We encourage our customers and users to report to us any of the following violations of "network etiquette." We will investigate all reports of violations and, pending our investigation, we will suspend the account of any customers who, in our sole judgment, have originated or are in any other way responsible for such activities.

The violations are as follows:
Using a TZO.COM hosted domain or using a TZO.COM Service to send bulk unsolicited e-mailings, bulk commercial advertisements or bulk informal announcements (generally known as SPAMMING), whether or not such activities provoke complaints from the recipients. Also hosting a mail service with a server accomodating an excessive number of mail boxes is a violation of the service. As a rule of thumb, an "excessive number" is more than a hundred mail boxes.

Using a TZO.COM hosted domain or using a TZO.COM Service to post an article or substantially similar articles to an excessive number of newsgroups or continued posting of articles, which are off-topic (i.e. off-topic according to the newsgroup charter), or the article provokes complaints from the readers of the newsgroup for being off-topic.

Engaging in SPAMMING from a provider other than The Tzolkin Corporation and using a TZO.COM Service as a response point.

Consequences Resulting from Unacceptable Uses - The Tzolkin Corporation reserves the right to suspend access to TZO.COM Service(s) by notifying you of a violation of this Policy. If you fail to promptly correct such violations and comply with this Policy The Tzolkin Corporation may suspend your account(s). You will not be entitled to a refund.

If you attempt to violate this policy and are unsuccessful in doing so, this in itself constitutes a violation of this Agreement. Any actual or attempted violations by a third party on your behalf shall be considered violations of this Agreement by you.

Suspension of Service - The Tzolkin Corporation reserves the right to suspend the account of any customer who violates the terms of this Policy. Suspension may occur without notice and in the case of suspension with cause there will be no refund.

Right of Appeal - Any TZO.COM user who believes that the TZO.COM service has been suspended unjustly can appeal to The Tzolkin Corporation for a review of the decision to suspend the service. An officer of The Tzolkin Corporation will review your appeal.

Indemnification - You agree to indemnify and hold harmless The Tzolkin Corporation, its officers, directors, employees, and agents from any losses, damages, costs, or expenses resulting from any action The Tzolkin Corporation takes arising from a third party claim or allegation that you have violated the terms of this Policy

Changes to this Policy - TZO.COM Service users acknowledge and agree that The Tzolkin Corporation may modify this policy at any time. The current version of the Policy is posted on the TZO.COM web site and the provisions of this Policy are binding on TZO.COM Service users and TZO.COM web site visitors. If you do not agree with these terms, conditions, and policies, then immediately send e-mail to abuse@TZO.COM or call us at 978 433-9638 to terminate your account and agreement.
